Terms and Conditions
General Terms and Conditions For Using the Song Pitch PRO online service.
“Company” means Song Pitch PRO
“Client” means you, the paying customer who subscribes to the company services.
1. AGREEMENT
These Terms and Conditions apply to all work done by the Company and online facilities supplied by the Company for the Client.
2. PITCHING FACILITIES
2.1 Song Pitch PRO reserves the right to accept or decline The Clients song(s) based on The Companies own quality control. Decision will be made by The Company, and The Client will be informed in writing on whether a meets our standards for pitching.
2.2 The Company shall make the clients song(s) available on the pitching database at all times during the clients subscription.
2.3 Every effort will be made by the Company to deliver a quality service throughout the clients subscription period and to make all song(s) available to relevant A&R and/or music managers via our website with intent to secure real interest from them. When such interest is shown, the Company agrees to pass over all contact information so as to facilitate the communication between A&R and client as quickly as possible.
3. THE CLIENT UPON SUBSCRIBING AGREES:
3.1 He/She is the credit card holder or has consent from the credit card holder (where a credit card has been the payment method.)
3.2 To submit a song, you must own the copyright to the material in question or be authorized by the copyright holder to act on their behalf. Song Pitch PRO shall not be responsible for any copyright issues with the Clients Recorded Material, including anything that constitutes a breach or infringement of any copyright or which shall be in any way illegal. The Client will indemnify Song Pitch PRO against any liability in respect thereof and shall pay all costs and expenses, which may be incurred by the Company in reference to any such claim. The indemnity shall extend to any amount paid on a lawyer's advice in respect of any such claim.
3.3 To accept email notification from The Company in respect to their subscription for updates and relevant news.
3.4 Not to hold The Company liable in instances where no A&R interest is shown. Whilst every effort is made to secure A&R interest, the Company does not accept liability for and will not be liable for damages where projects do not secure A&R attention or do not meet the Clients standards.
4. THE FEES
4.1 The Client shall pay subscription fees in advance with a minimum of one month. Subscriptions can be cancelled at anytime by either party but if cancelled during a month cycle, the reminder of the month must be paid in full. Where a subscription is cancelled mid way through a month cycle, The Company agrees to continue pitching until the cycle period ends.
5. MEDIA, PERSONNEL AND EQUIPMENT
5.1 The Company will supply all mp3 streaming facilities and industry contacts through the pitch system, however no contacts will be disclosed to The Client unless interest is made by A&R and permission by A&R is granted.
5.2 The Client undertakes and agrees that it shall be responsible for copyright control on any material submitted to The Company. Please read our copyright notice.
6. INDEMNITY
The Client hereby agrees that the Company shall not be liable for any injury loss damage costs and/or expenses suffered by the Client arising from:
6.1 the Client's making, use or exploitation of the Recordings
6.2 any copyright issues with the Clients Recorded Material, including anything that constitutes a breach or infringement of any copyright, theft by third parties of your recorded material or anything which shall be in any way illegal. The Client will indemnify the Company against any liability in respect thereof and shall pay all costs and expenses, which may be incurred by the Company in reference to any such claim. The indemnity shall extend to any amount paid on a lawyer's advice in respect of any such claim.
8 . WEBSITE CANCELLATION AND BREAKDOWN
8.1 In the rare instances that the Company must cancel a subscription, the Client will either get a rescheduled pitching rotation or a refund.
8.2 In the instance that The Company website is down for a sustained period, The Client will either receive a full refund or an extended subscription to make up the difference.
